Diretor de provas da INDYCAR reeleito para importante cargo judicial na FIA

Kyle Novak, diretor de provas de longa data da NTT INDYCAR SERIES e da INDY NXT by Firestone, foi reeleito para integrar o Tribunal Internacional de Apelações da FIA e o Tribunal Internacional da FIA.

Novak foi eleito inicialmente em 2022 e concluiu seu primeiro mandato de quatro anos. Sua reeleição marca o início de um segundo mandato de quatro anos, após votação realizada em 12 de dezembro na Assembleia Geral da FIA, no Uzbequistão.

Ele foi nomeado pelo ACCUS (Comitê de Competição Automobilística dos Estados Unidos). Esse grupo foi fundado em 1957 e serve como elo oficial entre os órgãos reguladores dos EUA e a FIA.

A nomeação coloca Novak entre apenas 36 juízes em todo o mundo, um grupo composto por advogados especializados em automobilismo e esportes de todo o planeta. Normalmente, cada país tem direito a no máximo dois representantes. Novak é um dos dois nomeados pelos Estados Unidos, juntamente com Gary Crotty, consultor jurídico da NASCAR.

“Minha participação neste tribunal me proporciona a oportunidade de interagir com algumas das mentes jurídicas mais brilhantes do automobilismo mundial”, disse Novak. “Nossos dias são repletos de discussões sobre alguns dos tópicos mais complexos da governança do automobilismo.”

O Tribunal Internacional da FIA atua como órgão judicial de primeira instância e julga casos disciplinares apresentados pelo presidente da FIA. O Tribunal Internacional de Apelação da FIA funciona como autoridade de última instância, revisando decisões emitidas por comissários e outros órgãos esportivos e disciplinares da FIA, incluindo o Tribunal Internacional.

Atuar no Tribunal Internacional de Apelações e no Tribunal Internacional da FIA é amplamente considerado o equivalente, no automobilismo, à Suprema Corte dos Estados Unidos – a instância máxima de recurso, após o esgotamento de todos os recursos internos da FIA.

Advogado aprovado no exame da Ordem dos Advogados de Michigan, Novak (foto acima) é o único representante da NTT INDYCAR SERIES entre os juízes da FIA.

Novak disse que é uma honra representar a categoria em audiências ou na participação em conferências anuais, observando que todos os envolvidos são fãs de automobilismo. Como exemplo, ele lembrou de um café da manhã que tomou no outono passado em Paris com um colega espanhol que sabia tudo sobre a NTT INDYCAR SERIES por acompanhar o tetracampeão da categoria, Alex Palou, que também é espanhol.

“Inicialmente, fiquei surpreso com o alto nível de interesse dos meus colegas na INDYCAR”, disse Novak. “Esse interesse demonstra o alcance global da INDYCAR. Espero que minha participação neste tribunal continue a aumentar a conscientização e a fortalecer ainda mais o status da INDYCAR como uma das principais entidades reguladoras do automobilismo.”

Nos últimos anos, Novak analisou casos envolvendo competidores e clubes filiados em diversas modalidades, incluindo corridas de carros esportivos e kart, além de um caso entre um clube filiado e a própria FIA. Todos os processos são conduzidos presencialmente, em Genebra ou na sede da FIA em Paris.

Novak afirmou que a experiência teve um impacto direto em suas funções de árbitro na NTT INDYCAR SERIES.

“Mesmo nos casos em que não estou atuando como juiz, recebemos toda a correspondência, o que nos permite observar como os regulamentos são redigidos e quanta litigância pode surgir de sua interpretação e aplicação”, disse Novak. “Sempre que analisamos um caso, penso em como uma situação semelhante poderia se desenrolar na INDYCAR.”

“Algumas dessas questões podem ser surpreendentemente pequenas. Um caso no kartismo envolveu um competidor que fez um gesto obsceno, o que resultou em uma desclassificação completa do fim de semana. Observar como outras entidades reguladoras lidam com situações como essa imediatamente nos faz perguntar: 'O que faríamos nesse caso? Se houvesse recurso, qual seria o resultado? Nossos regulamentos são suficientemente rigorosos para lidar com isso e, se não, como podemos aprimorá-los?'”

“Tudo o que eu aprender nesta função poderá ser aplicado diretamente na INDYCAR.”

INDYCAR Race Director Re-Elected To Key FIA Judicial Role

Kyle Novak, longtime race director for the NTT INDYCAR SERIES and INDY NXT by Firestone, has been re-elected to serve on the FIA International Court of Appeal and the FIA International Tribunal.

Novak was initially elected in 2022 and has completed his first four-year term. His re-election marks the beginning of a second four-year term following a Dec. 12 vote at the FIA General Assembly in Uzbekistan.

He was appointed by ACCUS (Automobile Competition Committee for the United States). That group was founded in 1957 and serves as the official liaison of the U.S. sanctioning bodies to the FIA.

The appointment places Novak among just 36 judges worldwide, a group composed of motorsports and sports attorneys from across the globe. Typically, each country is limited to no more than two representatives. Novak is one of two appointed from the United States, alongside Gary Crotty, legal counsel for NASCAR.

“My participation on this court provides me the opportunity to interact with some of the finest motorsports legal minds in the world,” Novak said. “Our days are filled with discussions on some of the most intricate topics in motorsports governance.

“These cases provide the backbone for future motorsports governance, both internationally and here in the United States. While FIA statutes are not binding on our championship, INDYCAR must constantly adapt to meet the challenges of an ever-evolving global motorsports landscape.”

The FIA International Tribunal serves as the first-instance judicial body and hears disciplinary matters brought before it by the FIA president. The FIA International Court of Appeal functions as the final appellate authority, reviewing decisions issued by stewards and other FIA sporting and disciplinary bodies, including the International Tribunal.

Serving on the FIA’s International Court of Appeal and International Tribunal is widely regarded as the motorsports equivalent of the United States Supreme Court – the final court of last resort once all internal FIA appeals have been exhausted.

An attorney who passed the bar in Michigan, Novak (photo, above) is the sole representative from the NTT INDYCAR SERIES among the FIA judges.

Novak said it’s an honor to represent the series when hearing cases or attending annual conferences, noting everyone involved is a racing fan. As an example, he recalled having breakfast last fall in Paris with a Spanish colleague who knew everything about the NTT INDYCAR SERIES through following four-time series champion Alex Palou, who also hails from Spain.

“I was initially surprised by the high level of interest in INDYCAR from my colleagues,” Novak said. “That interest demonstrates the global reach INDYCAR has. I hope my involvement on this court continues to raise awareness and further strengthen INDYCAR’s status as a premier motorsports sanctioning body.”

Over the past several years, Novak has heard cases involving competitors and member clubs across multiple disciplines, including sports car racing and karting, as well as a case between a member club and the FIA itself. All proceedings are conducted in person, either in Geneva or at FIA headquarters in Paris.

Novak said the experience has produced a direct impact on his officiating duties in the NTT INDYCAR SERIES.

“Even in cases where I’m not sitting as a judge, we receive all the correspondence, which allows us to observe how regulations are written and how much litigation can arise from their interpretation and application,” Novak said. “Whenever we hear a case, I’m always thinking about how a similar situation might play out at INDYCAR.

“Some of these matters can be surprisingly small. One karting case involved a competitor making an obscene gesture, which resulted in a full-weekend disqualification. Seeing how other sanctioning bodies handle situations like that immediately makes you ask: ‘What would we do here? If it were appealed, how would it turn out? Are our regulations strong enough to handle it, and if not, how can we improve them?’

“Everything I learn in this role can be applied directly back to INDYCAR.”
